1) Acceptance of Terms

These Terms govern your access to and use of PhotoFovea’s website, galleries, and purchasing options. We may update these Terms periodically; if you continue using the site after we post changes, you accept the revised Terms.

2) Store, Payments & Fulfillment

• Payments via PayPal. PayPal securely processes all transactions according to PayPal’s policies. PhotoFovea does not store payment card details on this site.
• Fine Art America (FAA). Some products/prints are purchased or fulfilled via FAA and follow FAA’s terms and fulfillment processes. Learn more on the Fine Art America website.
• Pricing & Taxes. We may adjust prices without notice. The payment processor calculates taxes based on your shipping destination.
• Shipping. Shipping times vary by product, edition, and destination. After we process your order, you receive email updates.

3) Limited Editions & Authenticity

Limited-edition works (when designated) are hand-signed, numbered, and delivered with a record of authenticity. We may update edition sizes and availability at our discretion prior to sale completion.

4) Returns & Cancellations

All fine art print sales are final once production begins. If your order arrives damaged or incorrect, contact info@photofovea.com within 7 days of delivery. Please include photos of the issue so we can help with a replacement or remedy.

5) Intellectual Property

All images, text, and materials on this site are protected by U.S. and international copyright laws. Unless we grant written permission, you may not copy, reproduce, modify, publish, distribute, display, sell, or create derivative works from the content. Personal, non-commercial viewing of the website is permitted.

6) Personal License for Purchased Prints

When you purchase a physical print, you receive the physical artwork—not the copyright. You may not reproduce, scan, photograph, publish, or distribute the artwork or digital images without written permission.

7) Prohibited Uses

Do not attempt to gain unauthorized access, interfere with site operations, scrape content without permission, or use the content for any unlawful or infringing purpose.

8) Third-Party Links & Embeds

This site may contain links to or embedded content from third-party services (e.g., FAA, PayPal, social platforms). We do not control their content, policies, or practices. Your use of those services is governed by their respective terms.

9) Disclaimer of Warranties

This website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the site will function without interruption or error.

10) Limitation of Liability

To the maximum extent permitted by law, PhotoFovea is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or your purchase of products.

11) Indemnification

You agree to indemnify and hold harmless PhotoFovea from claims, damages, and expenses that arise from your violation of these Terms or your misuse of the site.

12) Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Venue for disputes lies in the state or federal courts located in Colorado.
